一、創新創業項目申報條件

I. Eligibility Criteria for Innovation and Entrepreneurship

Project Application

(一)外籍人才

(A)Foreign Talent

1.年齡應在18-50周歲，身心健康，無犯罪記錄；

Aged between 18 and 50, physically and mentally healthy, with no criminal record;

2.應為創新創業項目或團隊主導者、策劃者等核心成員；

Should be a core member of the innovation and entrepreneurship project or team, such as the leader or planner;

3.在國（境）內外高等院校取得碩士及以上學位，特別優秀的外籍畢業生可適當放寬學歷要求；

Hold a master's degree or above from a domestic or international higher education institution; exceptionally outstanding foreign graduates may have the academic requirement appropriately relaxed;

4.以專利、科研成果、專有技術等創辦科技企業的外籍人才優先支持。

Priority support will be given to foreign talent who establish technology enterprises based on patents, scientific research achievements, proprietary technologies, etc.

（二）創新創業項目

(B)Innovation and Entrepreneurship Project

1.符合新區產業發展方向，具有創新要素與國際競爭力的高新技術、成果轉化等項目優先；

Projects aligned with the New Area's industrial development direction, especially high-tech projects, technology transfer projects with innovative elements and international competitiveness, will be prioritized;

2.具備完整的發展規劃、實施路徑、管理制度等，制定商業計劃書；

Possess a complete development plan, implementation path, management system, etc., and have prepared a business plan;

3.技術來源清晰，無知識產權權屬糾紛；市場發展潛力大，預期的經濟與社會效益顯著；

Clear technology source with no intellectual property ownership disputes; significant market development potential and expected economic and social benefits;

4.研發、生產類項目需符合國家生態環境、安全生產等相關規定；

R&D and production projects must comply with national regulations on ecological environment, work safety, and other relevant requirements;

5.與科創載體簽訂入孵協議，自愿接受并遵守科創載體的相關管理制度。

Sign an incubation agreement with the innovation carrier and voluntarily accept and comply with its relevant management systems.

二、申請材料

II. Application Materials

1.有效期內護照及簽證；

Valid passport and visa;

2.創新創業項目商業計劃書；

Business plan for the innovation and entrepreneurship project;

3.體檢證明；

Medical examination certificate;

4.最高學位（學歷）證書；

Highest degree (diploma)certificate;

5.國內高等院校畢業生提供學校出具的在校表現情況；

Graduates from domestic higher education institutions should provide a certificate of their performance during studies issued by the university;

6.團隊創業的，需提供創業人員職責分工、股份占比等證明材料；

For team entrepreneurship, provide supporting documents such as role division and shareholding percentages among team members;

7.境內、境外（申請人國籍國或經常居住國）無犯罪記錄證明。

Certificate of no criminal record issued by authorities in China and the applicant's country of nationality or habitual residence.

三、申請程序

III. Application Procedure

1.申報。外籍人才向科創載體提出創新創業項目申請，填寫《西咸新區外籍人才創新創業項目申請報告》并提交相關佐證材料；

Application.Foreign talent submits an innovation and entrepreneurship project application to the innovation carrier, fills out theXixian New Area Foreign Talent Innovation and Entrepreneurship Project Application Report, and provides relevant supporting documents.

2.審核。經審核通過的創新創業項目，由新城（園辦）科技管理部門向科創載體及創新創業項目出具《西咸新區外籍人才創新創業項目審核意見書》；

Review.Approved innovation and entrepreneurship projects will receive the "Xixian New Area Foreign Talent Innovation and Entrepreneurship Project Review Opinion Letter" issued by the science and technology management department of the respective New City (Energy Financial and Trade Zone)to the innovation carrier and the project;

3.入駐。科創載體與創新創業項目簽訂入孵協議，并辦理創新創業項目入駐程序；

Incubation Admission.The innovation carrier signs an incubation agreement with the innovation and entrepreneurship project and completes the project admission procedures;

4.辦證?？苿撦d體為外籍人才申辦工作許可及居留許可。工作許可審核通過后，由科創載體在外國來華工作管理服務系統中下載《外國人來華工作許可通知書》，并協助其在電子社保卡APP中申領外國專家來華工作許可證。憑《外國人來華工作許可通知書》或電子社?？ㄇ巴鋈刖彻芾聿块T辦理居留許可。

Permit Processing.The innovation carrier applies for the work permit and residence permit for the foreign talent. After the work permit application is approved, the innovation carrier shall download theNotice of the Work Permit for Foreigners Working in Chinafrom the Foreigner's Work Management Service System, and assist the foreign talent in obtaining theForeign Expert Work Permit Certificatevia the E-Social Security Card APP. The residence permit shall then be applied for at the entry-exit administration department by presenting either theNotice of the Work Permit for Foreigners Working in Chinaor the electronic permit on the E-Social Security Card APP.

四、創新創業項目運營評估

IV. Operation Assessment of Innovation and Entrepreneurship Projects

1.科創載體根據外籍人才獲批工作許可時間，每6個月開展一次創新創業項目運營評估；

The innovation carrier conducts an operational assessment of the innovation and entrepreneurship project every 6 months, starting from the date the foreign talent's work permit is approved;

2.創新創業項目運營評估實行分級量化評估，90分以上評估結果為A（優秀），80-90分（含）評估結果為B（良好），60-80分（含）評估結果為C（合格），60分以下評估結果為D（不合格）。

The operation assessment adopts a graded quantitative system: A (Excellent)for scores above 90; B (Good)for scores between 80 and 90 (inclusive); C (Qualified)for scores between 60 and 80 (inclusive); D (Unqualified)for scores below 60.

3.評估指標包括基礎指標和運營指標

Assessment indicators include Basic Indicators and Operational Indicators.

基礎指標（40分）

Basic Indicators (40 points)

（1）創新創業項目運營報告：創新創業項目商業計劃書執行情況，創新創業項目或公司發展情況、運營投入、市場拓展等方面內容，視整體運營情況得1-10分；

Project Operation Report:Implementation of the business plan, project/company development, operational investment, market expansion, etc. Score 1-10 points depending on overall operational status.

（2）創業公司注冊資本：創新創業項目已注冊創業公司，注冊資本1萬-10萬元得5分，10萬元（含）-50萬元得8分，50萬元（含）以上得10分；

Registered Capital of Startup Company:If the project has registered a startup company: 5 points for registered capital between RMB 10,000 - 100,000; 8 points for RMB 100,000 (inclusive)- 500,000; 10 points for RMB 500,000 (inclusive)or above.

（3）財務管理：創新創業項目制定完善的財務管理制度，依法記賬、報稅、納稅，視財務完備情況得1-5分；

Financial Management:Establishment of a sound financial management system, legal bookkeeping, tax filing, and tax payment. Score 1-5 points depending on financial completeness.

（4）運營投入：制定完善有效的發展計劃，持續投入資金、人員等，有效進行成果研發、市場拓展、對外合作等，視運營投入情況得1-5分；

Operational Investment:Formulating sound and effective development plans, continuous investment in funds, personnel, etc., effective conduct of R&D, market expansion, external cooperation, etc. Score 1-5 points depending on operational investment.

（5）人力資源：創新創業項目或公司與員工依法簽訂勞動合同，并按時按量繳納社保發放工資，視人力資源完備情況得1-5分；

Human Resources:The project/company signs labor contracts with employees according to law, and pays social insurance and salaries on time and in full. Score 1-5 points depending on human resources completeness.

（6）孵化管理：遵守服從科創載體各項管理制度，配合創業評估相關工作，參與各類孵化培育、文化融入、企業交流等活動，視管理情況得1-5分。

Incubation Management:Comply with and follow the innovation carrier's management systems, cooperate with entrepreneurship assessment work, participate in various incubation training, cultural integration, enterprise exchange activities, etc. Score 1-5 points depending on management compliance.

運營指標（60分）

Operational Indicators (60 points)

（1）項目營收：創新創業項目營收加分項，評估前半年內項目營收10萬元下的不得分，達到10萬元的得20分，超過部分按照實際超過額度的萬分之一予以加分，最高60分；

Project Revenue:Revenue bonus points. No points for revenue below RMB 100,000 in the 6 months prior to assessment; 20 points for reaching RMB 100,000; for amounts exceeding this, add 0.01 point per RMB 1 of excess revenue, capped at 60 points.

（2）人才引進：介紹和引進外籍人才或海外人才入區創業、就業的，引進外籍碩士得5分，外籍博士得10分，引進海外項目、外資企業的，視投資額、技術水平等情況得20-40分；

Talent Introduction:Introducing and bringing foreign or overseas talent to the zone for entrepreneurship or employment: 5 points for introducing a foreign master's holder, 10 points for a foreign Ph.D. holder. Introducing overseas projects or foreign-funded enterprises: score 20-40 points depending on investment amount, technical level, etc.

（3）新區企業出海服務：幫助區內科技企業技術、產品鏈接海外資源，拓展海外市場，每組織或參加一次活動得1分，有效鏈接資源建立合作得2分，完成一項出海服務/合同簽訂等得20分；

Outbound Services for New Area Enterprises:Assisting technology enterprises in the zone to connect their technology/products with overseas resources and expand into overseas markets: 1 point per activity organized or participated in; 2 points for effectively linking resources and establishing cooperation; 20 points for completing an outbound service project/contract signing, etc.

（4）投 融 資：創新創業項目獲得投融資，按照融資額的萬分之一予以加分，最高40分；

Investment & Financing:The project receives investment/financing. Add 0.01 point per RMB 1 of financing amount, capped at 40 points.

（5）成果產出：研發、專利、產品等相關成果取得階段性進展，每項5分，注冊專利、獲得獎項、參加展出的，每項10分，最高30分；

Output of Achievements:Making phased progress in R&D, patents, products, etc.: 5 points per item. Registering a patent, winning an award, participating in an exhibition: 10 points per item. Maximum 30 points.

（6）團隊建設：創新創業項目團隊建設，雇傭員工1--2人，每人得2分，3--5人，每人得3分，6人及以上得20分，最高20分。

Team Building:Project team building: Employing 1-2 staff: 2 points per person; 3-5 staff: 3 points per person; 6 or more staff: 20 points total. Maximum 20 points.

（7）有下列情況之一的直接評定為D（不合格），同步注銷其工作許可及居留許可，情節嚴重的按規定承擔相關法律責任。

Projects falling under any of the following circumstances will be directly rated D (Unqualified), and their work permits and residence permits will be revoked simultaneously. Serious cases shall bear relevant legal liabilities according to regulations.

①違反國家及地方政府關于外國人相關管理規定的；

(i) Violating national and local government regulations concerning the management of foreigners;

②不配合外專、公安、稅務、人社等相關部門，以及科創載體日常管理的；

(ii) Failing to cooperate with the daily management of relevant departments such as foreign experts affairs, public security, taxation, and human resources and social security, as well as the innovation carrier;

③提供虛假運營評估相關資料；

(iii) Providing false materials for the operational assessment;

④超過2周未在科創載體辦公，且未報備行程的；

(iv) Being absent from the innovation carrier's office for more than 2 weeks without reporting the itinerary;

⑤未實際從事申報項目創業工作的；

(v) Not actually engaged in the entrepreneurial work of the declared project;

⑥其他未列明相關情況。

(vi) Other related circumstances not listed.

五、退出機制

V. Exit Mechanism

外籍人才創新創業期內主動申請退出創業的，應向科創載體報送書面材料，完成公司注銷、清繳稅款等手續，并按創業申請程序完成工作許可及居留許可注銷工作。

Foreign talent who voluntarily apply to exit entrepreneurship during the innovation and entrepreneurship period should submit written materials to the innovation carrier, complete procedures such as company deregistration and tax settlement, and complete the revocation of work permits and residence permits according to the entrepreneurship application procedure.

六、有關說明

VI. Supplementary Notes

1.外籍人才創新創業工作應在經批準開展此項工作的科創載體內進行。

Innovation and entrepreneurship activities of foreign talent should be conducted within innovation carriers approved for such work.

2.工作許可有效期為6個月?？商岢鲎疃?次，每次不超過6個月的延期申請。累計有效期不超過2年。2年后按照現行外國人來華工作許可有關要求延期。

The work permit is valid for 6 months. Up to 3 extension applications may be submitted, each for a maximum of 6 months. The cumulative validity period shall not exceed 2 years. After 2 years, extensions will be processed according to the current requirements for foreigners' work permits in China.

3.外籍人才創新創業期內出差或離開西安范圍，需提前3個工作日向科創載體報告行程；外籍人才歸國或離境，需提前10個工作日書面告知科創載體，載明歸國或離境時長及計劃返回日期。返回后應及時向科創載體報備。

During the innovation and entrepreneurship period, foreign talent must report their itinerary to the innovation carrier at least 3 working days in advance for business trips or travel outside Xi'an's administrative area; for returning to their home country or leaving China, they must notify the innovation carrier in writing at least 10 working days in advance, specifying the duration and planned return date. They must report back to the innovation carrier promptly upon return.

4.外籍人才創新創業期內變更創新創業項目的，應提前15個工作日書面告知科創載體，并填寫《西咸新區外籍人才創新創業項目變更申請報告》，由科創載體按照初次審核要求進行審核備案。

If changing the innovation and entrepreneurship project during the period, foreign talent should notify the innovation carrier in writing at least 15 working days in advance, and fill out the "Xixian New Area Foreign Talent Innovation and Entrepreneurship Project Change Application Report". The innovation carrier will review and file it according to the initial review requirements.

5.創新創業項目運營評估結果累計2次為D（不合格）的，創新創業項目終止。

The innovation and entrepreneurship project will be terminated if it receives a D (Unqualified)rating twice consecutively in the operational assessment.

6.創新創業項目申請審核、工作許可辦理均不收費。

No fees are charged for the application review of innovation and entrepreneurship projects or the processing of work permits.

1.外籍人才在申報創新創業項目時是否需要注冊公司？

Does foreign talent need to register a company when applying for the innovation and entrepreneurship project?

創新創業項目的外籍人才首次辦理工作許可，是由科創載體作為申請主體，無需公司注冊相關資料。

When foreign talent for the innovation and entrepreneurship project apply for the work permit for the first time, the innovation carrier acts as the applicant entity. Company registration documents are not required at this stage.

2.外籍人才首次辦理工作許可能否由自己的公司申請？

Can foreign talent apply for the work permit for the first time through their own company?

不能，因外籍人才創新創業工作是對外國人來華工作申請條件的突破，放寬外籍人才相關條件，因此首次辦理工作許可，是由科創載體作為申請主體。創新創業項目運營評估結果為B（良好）以上的，在延期申請時可由外籍人才自己的公司進行申請。

No. The innovation and entrepreneurship program for foreign talent represents a relaxation of the standard conditions for foreigners working in China. Therefore, for the initial work permit application, the innovation carrier must act as the applicant entity. If the operational assessment result of the innovation and entrepreneurship project is B (Good)or above, the foreign talent's own company can act as the applicant entity for extension applications.

3.創新創業項目的外籍人才能否邀請家屬入境，辦理相關簽證？

Can foreign talent in innovation and entrepreneurship projects invite family members to China and apply for relevant visas?

可以。在中國工作的外國人可以為其配偶、父母、未滿18周歲的子女或配偶的父母均可以申請S簽證，有以下兩種方式

Yes. Foreigners working in China can apply for S visas for their spouses, parents, children under 18 years old, or their spouses' parents. There are two ways:

（1）外籍人才在首次辦理工作許可時，向科創載體提交家屬相關資料，由科創載體在辦理工作許可時一并提交，審核通過后的外國人來華工作許可會附帶家屬相關信息，外籍人才家屬憑工作許可通知前往當地中國使領館辦理入境手續。

When applying for the work permit for the first time, the foreign talent submits family member information to the innovation carrier. The carrier includes this information in the work permit application. Once approved, the work permit notice will contain the family member information. Family members can then use this notice to apply for entry visas at the local Chinese embassy/consulate.

（2）外籍人才取得工作許可后，可向出入境管理部門提交申請，為家屬辦理S簽證。

After obtaining the work permit, the foreign talent can apply directly to the immigration authorities for S visas for family members.

4.外籍人才創業公司能否邀請商業伙伴、客戶前往中國商務考察？

Can foreign talent's startup company invite business partners or clients to China for business visits?

可以，邀請外國人來華短期訪問需向西安市人民政府外事辦公室申請。

5.外籍人才創業公司開戶困難，在中國境內公司不能美元交易？

Foreign talent's startup company faces difficulties opening a bank account. Can companies in China not transact in USD?

在中國境內的外國人公司正常均可在各類銀行注冊對公對外賬戶，因語言、程序等問題，可由科創載體或專業財務公司協助辦理。

Foreign-owned companies in China can normally open corporate foreign currency accounts at various banks. If facing difficulties due to language or procedures, the innovation carrier or professional financial firms can assist.

根據《中華人民共和國外匯管理條例》規定，中華人民共和國境內禁止外幣流通，并不得以外幣計價結算。因此境內公司交易不能使用美元。

According to the provisions of theRegulations of the People's Republic of China on Foreign Exchange Control, the circulation of foreign currency is prohibited within the territory of the People's Republic of China, and settlement in foreign currency is not allowed. Therefore, domestic companies cannot use USD for transactions.

7.在中國境內就業的外國人是否需要參加社會保險？

Are foreigners employed within China required to participate in social insurance?

在中國境內依法注冊或者登記的企業、事業單位、社會團體、民辦非企業單位、基金會、律師事務所、會計師事務所等組織（以下稱用人單位）依法招用的外國人，應當依法參加職工基本養老保險、職工基本醫療保險、工傷保險、失業保險和生育保險，由用人單位和本人按照規定繳納社會保險費。

用人單位招用外國人的，應當自辦理就業證件之日起30日內為其辦理社會保險登記。

Foreigners legally recruited by organizations such as enterprises, public institutions, social groups, private non-enterprise units, foundations, law firms, accounting firms, etc., that are legally registered or established within China (hereinafter referred to as "employing units") shall, according to law, participate in basic pension insurance for employees, basic medical insurance for employees, work-related injury insurance, unemployment insurance, and maternity insurance. Social insurance premiums shall be paid by the employing unit and the individual in accordance with regulations.

Employing units that recruit foreigners shall handle social insurance registration for them within 30 days from the date of obtaining the employment permit.
